24.04.2024 - 14:26The Ministry of Defense of Ukraine has published the main provisions of the law on strengthening mobilization.
The Mobilization Law, with new amendments, passed by parliament and signed by Ukrainian President Volodymyr Zelensky, will come into force on May 18.
In particular, it clarifies the duties of those being mobilized, the responsibility for not updating data and for not appearing at the territorial recruitment center, the fulfillment of transport duties and the reasons for deferment.
What will change after the law comes into force?
The Mobilization Law stipulates that men of conscription age in Ukraine:
- must carry and present military registration documents upon request by authorized persons;
- update their registration data through the Center for the Provision of Administrative Services or the electronic cabinet;
- appear at the territorial recruitment center when summoned for military registration, medical examination and determination of assignment for a special period;
- report reasons for not arriving within a specified period;
- mandatory appearance at assembly points when summoned or called up.
Furthermore, citizens can be involved in defense work and the execution of mobilization tasks.
Additionally, citizens must provide property, buildings and transportation to the Armed Forces, other military formations and civil defense forces with compensation from the state.
If a citizen fails to fulfill their duties, then:
- the head of the territorial recruitment center refers the matter to the police for administrative detention and delivery of the citizen;
- if detention is not possible, the head of the territorial recruitment center sends a registered letter to the citizen demanding fulfillment of their duties;
- the form and content of the demand are determined by the Ministry of Defense. The day of delivery of the demand is the day of receipt or refusal to receive;
- the territorial recruitment center issues a document confirming compliance with the demand or sends a notification of compliance with the demand to the relevant authorities;
- the demand is considered fulfilled after the citizen fulfills their duties, revoked after the end of mobilization;
- if duties are not fulfilled within 10 days, the territorial recruitment center applies to the court for temporary restriction of the right to drive vehicles until the duties are fulfilled or the demand is revoked.
Exemptions from conscription include:
- reserved by authorities and on special military registration;
- persons with disabilities I, II, III, or temporarily unfit for service due to health reasons;
- families with three or more children under 18, single parents;
- adoptive parents, guardians of orphans and children deprived of parental care;
- persons caring for sick family members. First-degree relatives of military conscripts where there are members with disabilities I, II groups;
- members of families where there are deceased or missing persons during the anti-terrorist operation and other defense measures, members of families of deceased Heroes of Ukraine from the Heavenly Hundred;
- individuals studying in day or dual forms of education, scientific and scientific-pedagogical workers;
- officials of state bodies, members of parliament, judges, members of the government, employees of military authorities;
- diplomatic staff, civil servants in the field of cybersecurity and IT (staff of the Verkhovna Rada, the Cabinet of Ministers and the President’s Office);
- other persons defined by law.
Instead of compulsory military service, there will be basic military service for 5 and 3 months in peacetime and wartime, respectively. Ukrainian citizens aged 18 to 24 will be able to choose the year and period for undergoing basic service.
Earlier, the Ministry of Defense announced that consular services for men abroad would be provided only if their military registration data is updated. Passport issuance is possible only if a military ID is available.
