February 18, 2024After the Cabinet of Ministers of Ukraine allowed territorial recruitment centers to work around the clock during the martial law, sources from TSN.ua in military enlistment offices reported that they had not yet received additional explanations regarding what exactly they should do, for example, during curfew and at night.
Meanwhile, some Ukrainians interpreted such permission as implying that employees of territorial recruitment centers could walk around homes at night or detain curfew violators.
“For example, as far as the military medical commission is concerned, it does not take place at the territorial recruitment center. As for our work, since 2014, all Ukrainian servicemen have been on a special duty regime. That is, 24/7. And especially during martial law,” said TSN.ua from one of the regional territorial recruitment centers.
According to a representative of the military enlistment office, they honestly do not understand what exactly the government means by allowing territorial recruitment centers to work around the clock. In addition, the territorial recruitment centers added that they are not aiming to deal with those who, for example, violate the curfew.
“This is a matter for the police,” clarified an employee of the military enlistment office.
According to lawyer Rostyslav Kravets, no fundamental changes are expected due to the permission for territorial recruitment centers to work around the clock.
“I believe that this is done in order to be able to attract civilians to work around the clock in military enlistment offices,” says lawyer Rostyslav Kravets.
“If representatives of territorial recruitment centers come to someone’s home, they have the right not to open the door. Without a decision of an investigative judge allowing these individuals into the residential premises or property, a person has the right not to let anyone in. If it concerns the yard of a private house, they also do not have the right to enter it without the owner’s consent. Entering without consent constitutes unlawful entry.”
The issue of mobilization was also raised by former presidential advisor Oleksiy Arestovych. In one of his recent interviews, he recounted the following case:
“A soldier told me a story. He is fighting, and the military enlistment office came to his brother. The brother sees poorly with one eye and does not see at all with the other. They said that maintenance workers would come to repair the Internet, he opens the door, and there are representatives of the territorial recruitment center standing there.”
