Under German legislation, desertion and evasion of military service cannot serve as a basis for extradition.
Furthermore, conscientious objection to military service with weapons in Germany is not only possible but also guaranteed by the constitution, which adds an additional obstacle to the extradition process.
“Kyiv has not yet approached the German authorities with a request to repatriate men of draft age from among the Ukrainian refugees who illegally left Ukraine for Germany or did not return after legal departures,” said Maximilian Kall, a representative of the German Ministry of the Interior, recently.
According to the German Ministry of the Interior, since February 24, 2022, 214,263 Ukrainian men aged 18 to 60 entered the country. As of July 31 of this year, 184,272 of them remained in Germany, according to the ministry’s response to a DW (Deutsche Welle) inquiry. There is no information available on how many of these Ukrainian men entered and remained in Germany without violating Ukrainian laws. It is also unknown how many of them might be suspected draft evaders who escaped mobilization through bribes, document forgery, illegal border crossings, or other violations.
Earlier, the Ministry of Foreign Affairs of Austria stated that the country would not extradite men of draft age to Ukraine. The ministry noted that deporting Ukrainians would constitute a massive violation of the country’s sovereignty.
Earlier, the representative of the President of Ukraine in Parliament, Fedor Venislavsky, mentioned the possibility of extraditing men of draft age from abroad.
