‘We did not send them’: In Ireland, men from Ukraine have received letters regarding extradition
September 13, 2023Czech Republic will not extradite draft dodgers to Ukraine in accordance with the European Convention, which excludes extradition for military crimes such as draft evasion, desertion and disobedience to orders.
This statement was made by the official spokesperson of the Ministry of Justice of the country, Vladimir Repka, as reported by the local publication Idnes.
However, there may be individual exceptions.
Repka stated,
“Nevertheless, in a specific case, it will depend not on legal qualification but on the actual behavior for which Ukrainian judicial authorities will ultimately request the extradition of a specific individual.”
Earlier, Germany stated that they would not extradite draft dodgers to Ukraine. According to German legislation, desertion and draft evasion cannot be grounds for extradition. Furthermore, in Germany, conscientious objection to military service with weapons is not only possible but constitutionally guaranteed, which presents an additional obstacle to the extradition process.
Austria’s Ministry of Foreign Affairs also announced that the country would not extradite men of draft age to Ukraine. The ministry noted that deporting Ukrainians would be a massive infringement on the country’s sovereignty.
Previously, a representative of the President of Ukraine in parliament, Fedor Venislavsky, mentioned the possibility of extraditing men of draft age from abroad.
