October 9, 2023The Highest Anti-Corruption Court of Ukraine has closed the case regarding the “Rotterdam+” formula, which, during the tenure of former Ukrainian President Petro Poroshenko, tied the cost of electricity to the price of coal in the Netherlands. The case was closed due to the expiration of the pre-trial investigation period.
The decision was made by the panel of judges of the High Anti-Corruption Court during a preparatory hearing for the “Rotterdam+” case.
The Specialized Anti-Corruption Prosecutor’s Office of Ukraine intends to appeal the decision of the Highest Anti-Corruption Court.
According to the investigation, consumers of electricity overpaid the state nearly 20 billion hryvnias. “According to the investigation’s estimate, the introduced formula resulted in losses of 19.357 billion hryvnias to electricity consumers during 2016-2017.
The prosecutor has also filed a civil lawsuit to recover damages caused to the state by the criminal offense in the amount of 19.357 billion hryvnias,” the statement from the Specialized Anti-Corruption Prosecutor’s Office said.
It is noted that six individuals are suspected in the case.
Recall that in September of last year, the head of the Specialized Anti-Corruption Prosecutor’s Office, Alexander Klimenko, decided to annul the resolution to close the “Rotterdam+” case as illegal and unfounded, completely changing the group of prosecutors working on this case.
Following this decision, the National Anti-Corruption Bureau and the Specialized Anti-Corruption Prosecutor’s Office announced suspicions to 15 individuals involved in the introduction and implementation of the so-called “Rotterdam+” formula.
