13.10.2024 09:00In most cases, courts are overturning fines issued by territorial recruitment centers under the new mobilization rules.
This data comes from the service “Opendatabot.”
Over the five months since the introduction of the new regulations, at least 314 cases of fine cancellations have been found in the judicial registry. The number of such cases is increasing each month: 32 in July, 90 in August, and 148 in September.
The main reasons for the cancellation of fines include:
- Failure by the territorial recruitment centers to follow the proper procedure for issuing fines.
- Lack of convincing evidence of violations committed by citizens.
- Fines being issued for periods when the new regulations had not yet come into force, which serves as a basis for their cancellation.
Since the beginning of the year, nearly 12,000 fines for violations of military registration have been submitted for enforcement.
Previously, a lawyer explained that Ukrainian courts are overturning the majority of fines imposed by territorial recruitment centers for violations of mobilization legislation. He noted that fines are frequently issued, and many related cases are being heard, with 88% of cases being won against the territorial recruitment centers.
Additionally, the media reported that the Verkhovna Rada is considering simplifying the process for issuing fines in absentia by the territorial recruitment centers.
