06.05.2024 - 09:22Details have emerged on how remote fines for draft dodgers will be enforced. They are provided for in bill 10379 amending the Administrative Code, which the committee of the Verkhovna Rada of Ukraine approved for the second reading.
The specifics are outlined in the “Judicial and Legal Newspaper.”
The bill states that if an individual fails to update their data, does not inform the territorial recruitment center of changes in personal information (which are not present in electronic registries), fails to appear upon summons, or otherwise violates “mobilization” rules, the territorial recruitment center can issue a fine without drawing up a protocol.
However, for this, the territorial recruitment center must have confirming documents that the individual received such a summons. The exact nature of these documents is not specified in the bill. The “Judicial and Legal Newspaper” speculates, based on the analogy with the law on mobilization, that it may be sufficient to mark the impossibility of delivery to the registered address in a postal message.
Under current law, fines can only be issued in person, in the presence of the violator. Member of the Law Enforcement Committee of the Verkhovna Rada Andriy Osadchuk believes that under the new procedure, remote fines, opening of enforcement proceedings, and consequently, as noted by Osadchuk, the blocking of the violator’s accounts will become possible.
The fine can be issued within three months from the date of identifying the violation but no later than a year from the date of its commission.
The proposed fine for citizens is suggested to be increased to 17-25.5 thousand hryvnias (402-603 euros).
