October 2, 2024The Bolhrad District Court of the Odesa region has ordered the local territorial recruitment center to release a man who had been detained by the center’s staff and then sent to an assembly point, where he spent nearly a week.
The court’s ruling was published in the Unified State Register of Court Decisions.
The investigative judge received a complaint about the release of an illegally detained man, stating that on September 20, he was apprehended by police without any grounds and was being held at the assembly point without legal justification.
In court, the man explained that he was detained by the police at the Dachne checkpoint on the Odesa-Kyiv highway, and military recruitment officers were summoned. They took him to the Odesa assembly point without any explanation, where he was held for four days. Subsequently, he was taken to a military unit, where a doctor determined that he was unfit for service in the Armed Forces of Ukraine due to health reasons. On September 26, he was transported to another location, where he remained until the court hearing. The man added that he had not received any summons, had not undergone a military medical commission, had not refused to attend one, had not signed any documents, and was unaware of any detention protocol being drawn up.
The man’s lawyer noted that his client is registered as someone subject to military service at the local recruitment center, is not on any wanted list, and has been unlawfully deprived of his freedom, thus should be released.
According to the information from the “Reserve+” application, the man is not listed as wanted.
Considering the norms enshrined in the Constitution and the Convention on Human Rights, the judge ruled that the man’s right to freedom should be protected by the court and ordered the head of the territorial recruitment center to release him.
Recently, there has been a legal precedent regarding the illegality of mobilizing men under the age of 25.
Meanwhile, territorial recruitment centers have not begun issuing mass fines for violating military registration rules following the adoption of the new mobilization law. Most of the fines that have been issued have been overturned by the courts.
