This statement said Ombudsman of human rights Dmitriy Lubinets.
He voiced objections to the new controversial draft law on mobilization, which, according to him, spans nine pages.
Key points:
- The draft law proposes to require the registration of an electronic account for a draftee, military conscript, reservist, and failure to comply with this would result in certain legal consequences as stipulated by the law. However, such a provision in the draft law does not comply with the provisions of the Constitution, the law “On Personal Data Protection,” and the legal positions of the Constitutional Court regarding the official interpretation of the right to personal and family life.
- The draft law also mentions that the military command may impose a temporary restriction on the right of a Ukrainian citizen to leave the country. However, according to the requirements of Article 17 of the Constitution, the Armed Forces of Ukraine and other military formations cannot be used to restrict the rights and freedoms of citizens. Therefore, these proposed changes contradict the Constitution.
- The normative problem lies in the question of the procedure for the departure of men aged 18 to 60 who are on military registration or excluded from it in accordance with the established procedure. The issue here revolves around the terms “remove” and “exclude” from military registration (which are indicated in the military ID) becoming a practical problem requiring resolution.
