January 17, 2024The ombudsman, Dmitri Lubinets, emphasized that the employees of the Territorial centers of recruitment (TCR) lack the authority to inspect citizens’ documents and forcibly detain them for mobilization purposes. He highlighted citizens’ concerns about the TCR overstepping its mandates, particularly in demanding document checks and physically detaining individuals.
Lubinets mentioned that his office assists affected individuals by initiating legal proceedings, submitting inquiries and conducting monitoring checks on the TCR. Additionally, he expressed opposition to the proposed expansion of the TCR powers outlined in the government’s mobilization bill.
He is stressing that the TCR is a military unit, so according to the Ukrainian Constitution, they cannot engage in restricting the rights of citizens, even when a military status is legally established. He questioned the rationale behind granting the TCR more authority to check documents when existing bodies are responsible for verifying the documents of Ukrainian citizens. Lubinets also criticized the proposed provision in the bill, stating that the head of the TCR should be able to influence whether a Ukrainian citizen has full control over their property, deeming it nonsensical.
