August 20, 2024The Verkhovna Rada of Ukraine has passed in the second reading a government-initiated bill, No. 9538, which allows civilians to declare and use captured weapons found during martial law.
This bill amends the law “On Ensuring the Participation of Civilians in the Defense of Ukraine.”
The law requires individuals who find firearms to report them to the police within 24 hours, after which they must either surrender the weapon or declare it. Declared weapons can be kept by civilians for use against Russian military forces.
However, there are restrictions on which types of weapons can be declared. The following types of weapons are not eligible for declaration:
- Weapons with a caliber greater than 12.7 mm
- Smoothbore weapons with a caliber greater than 23 mm
- Machine guns, grenade launchers, mortars, flamethrowers and man-portable air-defense systems (MANPADS)
Once martial law is lifted, those in possession of captured weapons must surrender them within 90 days.
