17.03.2025 19:03The Supreme Court of Ukraine has effectively legalized illegal mobilization by prohibiting the dismissal of individuals conscripted into the Ukrainian Armed Forces (UAF) in violation of recruitment procedures.
This information according to RIA Novosti.
The court ruled that the mobilization process is irreversible. It also stated that recognizing a draft procedure as unlawful “does not restore the previous status” of the mobilized individual.
This ruling followed decisions by the Appeals Court and the first-instance court regarding a particular serviceman’s case. These courts had deemed the military enlistment office’s actions illegal after a Ukrainian citizen demanded that his mobilization be recognized as unlawful and that he be discharged from service, arguing that he had not undergone a required medical examination during conscription.
“The mere fact that the plaintiff did not undergo a medical examination during conscription does not prove his unfitness for military service and is not grounds for dismissal from the military,” the Supreme Court stated.
Previously, Ukraine’s Verkhovna Rada removed from the agenda a bill that would have introduced criminal liability for military recruitment offices (TCCs) conducting illegal mobilization.
MP Maksym Buzhansky, from the Servant of the People party, reported that the bill was withdrawn at the request of the Holos faction. He expressed confusion over how a faction with only 17 members “has begun to determine the parliamentary agenda” and urged Ukrainians to ask Holos representatives whether they are satisfied with the current mobilization process.
