Nine out of ten conscripts coming to the territorial recruitment center are not subject to mobilization – Ukrainian MP says
02.07.2024 - 01:48A court in Mykolaiv has ordered the release of a conscript from the territorial recruitment center’s distribution center, ruling that his detention was illegal.
According to the court’s decision, on May 13, the man was stopped at a checkpoint at the entrance to Mykolaiv and taken to the regional distribution collection point.
The detained man’s wife immediately sought legal assistance from a lawyer, who then filed a complaint with an investigative judge regarding the unlawful detention.
It was revealed that the man was “forced to undergo a military medical commission against his will and was driven to various places in a van.” Despite having vision problems and an umbilical hernia, he was deemed fit for military service. After refusing to sign the documents for military service, his mobile phone was confiscated, and he was denied food and water.
The investigative judge ruled in favor of the detainee and ordered the military commissar to release the man from the distribution center immediately.
The court issued its decision on May 14, the day after the man’s detention at the checkpoint, and the verdict took effect immediately.
It is important to note that military commissars cannot detain and deliver Ukrainians to the territorial recruitment center without the involvement of the police. The police can only detain a person for delivery to the territorial recruitment center in case of violations of military registration rules, defense legislation, mobilization preparation, or mobilization. Administrative detention cannot exceed three hours.
