07.06.2024 - 10:02A Ukrainian student, in his fourth year of undergraduate studies in Canada, won a court case regarding his mobilization in Ukraine.
This was reported by the “Judicial-Legal Gazette.”
The publication states that the fourth-year student at the University of Saskatchewan, who was deemed partially fit for service, was traveling by car from Ternopil towards the Polish border on September 9, 2023, to accompany his brother who was about to cross the border. A few kilometers before the border, he was stopped at a checkpoint, forcibly taken to the territorial recruitment center, registered for military service, required to undergo a military medical commission and enlisted on the same day. His phone was confiscated and his arguments were ignored.
The court ruled that the representatives of the territorial recruitment center were obligated to check for grounds for deferment. The court found the actions of the military commissars illegal, and the young man was removed from the personnel lists.
Additionally, the court stated that the young man was entitled to a deferment from conscription under Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization.”
It should be noted that it was previously reported that military commissars cannot detain and bring Ukrainians to territorial recruitment centers without police involvement. The police can detain a person to bring them to the recruitment center only in cases of violating military registration rules, defense legislation or mobilization preparation or mobilization. Administrative detention cannot exceed three hours.
