December 22, 2023Ukrainian Member of Parliament Maryana Bezuhla has outlined key provisions of the updated draft law on mobilization currently being prepared for registration and subsequent voting in the Verkhovna Rada of Ukraine.
The comprehensive list of provisions in the updated draft law includes:
- Conscription age for mobilization is set at 25 years (instead of the current 27 years).
- Rights for deferment and exemption from service are granted to:
- Individuals with disabilities of 1-2 groups (currently retaining 2nd group).
- Those with three or more children.
- If two servicemen have a child, one has deferment and the right to discharge (either male or female).
- Families with a minor disabled child.
- Families with an adult incapacitated child with disabilities / spouse or parents of the wife or husband of 1-2 groups (the disabled person chooses who gets the deferment).
- Guardians of incapacitated individuals recognized by a court as incapacitated.
- Pregnant women and women on maternity leave.
- Only incumbent MPs (all former MPs are excluded), and being elected as a deputy is grounds for dismissal.
- Women and men whose close relatives (spouse, son, daughter, father, mother, or full/half brother or sister) died or went missing during the Anti-Terrorist Operation (ATO) or Russia’s invasion.
- Granted deferment but not grounds for dismissal are:
- Applicants for consecutive higher education under 30 years old (inclusive).
- All scientists with academic titles.
- All full-time teachers.
- Conscripts are exempt from mobilization for 6 months after discharge.
- Not subject to mobilization for 2 years after discharge are individuals who were mobilized and discharged (except conscripts).
- Only by choice subject to mobilization are:
- Persons released from captivity.
- Women.
- Grounds for dismissal include:
- Former captives (involuntarily).
- Generals by decision of the military leadership.
- Those who served during the state of martial law for 36 months.
- Signing a short-term contract during mobilization (individuals aged 18-24, except officer personnel).
- Conscription service is abolished; conscripts are released. They all transition to the mobilization resource according to general rules (from 25 years old).
- Basic military training up to three months is introduced for all citizens aged 18-25 at all educational institutions. Optional basic military service is available up to 25 years old for those who did not undergo basic military training.
- Mobilization process:
- Local government bodies and administrations must facilitate, rather than contribute to, mobilization as previously.
- Mobilization of vehicles – expanded to all, except individuals. Clarification.
- Martial law:
- Limitation of draft evaders’ rights.
- Increased involvement of the national police.
- Military registration:
- All Ukrainian citizens aged 18-60, including those with deferments and those who can only be mobilized by choice.
- Introduction of a military registration document – Defender’s certificate (indicating conscription status, deferment, reserve, etc.).
- Military registration abroad determined by the Cabinet of Ministers.
- New obligations for citizens:
- Providing residence information to employers.
- Undergoing a medical examination during mobilization.
- Personally visiting Civil Service Centers (ЦНАП/ТЦК СП) to update information (they cannot mobilize citizens, only update data).
- Carrying the military registration document during the state of martial law (electronic equivalent – Defender’s certificate).
- State service:
- Admission to state service and law enforcement agencies only if completed basic military training or service.
- Reserve:
- Cabinet of Ministers reviews reservations.
- New criteria for reservations in government bodies (from 25 to 50%).
- Recruitment:
- Recruitment at Civil Service Centers, employment centers, and recruiting centers (voluntary only).
- Direct enlistment into military units through recruiting.
- Military service:
- Mobilized during training – recruit (cannot be used except for training; determination of capabilities, physical fitness, actual suitability; lower financial compensation). The possibility of sending a citizen unprepared to the front is completely eliminated.
- If the recruit does not pass the training stage, they can be discharged without additional costs to the state.
- Basic military service – recruit.
- The category “limited fitness” is eliminated. Only fit and unfit categories remain. Some will become unfit, some will be fit. Re-evaluation by a military medical board.
- Possibility of military service by conscription during mobilization by the choice of a person sentenced to probation.
- Social protection:
- 30-day leave once a year without division, granted three times over 36 months of mobilization.
- 90-day leave (without division) after captivity for those who continue to serve.
- The list of family circumstances for dismissal is determined by law (currently discrepancies between the law and the Cabinet of Ministers).
- Delivery options for call-up:
- Representatives of Civil Service Centers at Civil Service Centers.
- Representatives of Civil Service Centers, police at the place of residence.
- Representatives of Civil Service Centers, employers, police at the workplace.
- Representatives of Civil Service Centers, police at public places.
- Obligations of military command determined:
- Mandatory rotation on the confrontation line – not more than 6 months with a specified unit restoration period (still under development).
- Procedure for conscript discharge.
- Introducing logistical support for troops during the state of martial law involving civilian organizations.
- Further developments include:
- Military consulting companies.
- Non-compliance and service in separate units in case of refusal to carry out combat missions, etc.
