January 10, 2024In Ukraine, there has been a significant increase in the number of fathers who, through court processes, are gaining custody of children from mothers.
According to media reports, the overwhelming majority of divorces resulting in the mother being deprived of the right to raise the child in favor of the father are deemed to be fictitious, aimed at avoiding military mobilization.
As per media information, in 2019, there were only 589 such court decisions, and in just 133 cases, the verdicts were in favor of the father. However, the situation drastically changed in 2022: there were 859 instances where court decisions about joint residency and custody of children were awarded in favor of men. Furthermore, by 2023, Ukrainian courts had already recorded 2708 such decisions.
According to the law, a father with whom a minor child resides has the right to deferment from military mobilization.
